Update: On February 11, 2026 legislation was proposed in the Colorado Senate that would significantly alter the 1971 Colorado Noise Abatement Act. If enacted, this legislation would make pointless any continuation of our lawsuit and would essentially eviscerate the state-wide protections afforded for more than 50 years to Colorado citizens against harmful levels of noise pollution. The amendment will instead create a patchwork of local exceptions to this uniform scheme of regulation and its only effect can be, as seen in Salida and Colorado Springs, to significantly increase the levels of harmful noise pollution experienced in local neighborhoods. We are a group of concerned residents living near the Ford Amphitheater working towards a common goal: to stop the excessive and disruptive noise. Like you, we have experienced firsthand how concert noise can disrupt our lives, interrupt our sleep, and infringe on our right to peaceful enjoyment of our property.
We've tried every available avenue—filing complaints, attending town halls, and engaging with city officials—but these efforts have failed to provide a meaningful solution. We've concluded that the only path forward is to take legal action. Our goal is to compel compliance with existing noise limits in the Colorado Noise Abatement Act and restore peace to our neighborhoods.
In September of 2025, the Colorado Supreme Court concluded that local authorities, including Colorado Springs, do not have the authority to permit private, for-profit entities to create sound in excess of the state wide noise limit. Consequently, a lawsuit was filed in January 2026 to compel Venu to comply with state law.
